1. About these terms
Elysium Bookings is provided by BuiltBy2 Ltd, registered in England and Wales under company number 17153424, with registered office at 44 Stokesay Drive, Cheadle, Staffordshire, ST10 1YU, United Kingdom.
By creating an account or using Elysium, you agree to these terms. If you use Elysium for a business, you confirm that you have authority to bind that business. Mandatory consumer rights are not affected.
2. What Elysium provides
Elysium provides software for business discovery, appointments, client records, communications, payments, subscriptions, business administration, reporting and optional integrations across web, iOS and Android.
Elysium is the technology platform. The appointment business, not BuiltBy2, provides and is responsible for the booked service, its suitability, professional standards, pricing, availability, cancellation rules, refunds and client care.
3. Accounts and eligibility
You must provide accurate information, keep credentials and devices secure, maintain a current contact method and notify us promptly about suspected unauthorised access. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care.
Business owners control staff invitations, roles and access. They must remove access that is no longer required. Business accounts are intended for people legally able to operate or represent the relevant business.
4. Business responsibilities
A business is responsible for the legality and accuracy of its listing, services, prices, availability, policies, client communications and records. It must obtain any licences, insurance, consents and data-protection notices required for its work.
Businesses must not rely on Elysium as their only copy of information they are legally or professionally required to retain. Financial and tax tools support administration but are not accounting, tax or legal advice.
5. Bookings and business policies
A booking, request or waitlist place is between the client and the relevant business. The status shown by Elysium determines whether an appointment is confirmed, pending, declined, cancelled or otherwise incomplete.
Businesses may set booking, cancellation, rescheduling, deposit, card-hold and no-show terms. Those terms must be shown before they bind a client. Clients should review the business's terms and contact the business about the service itself.
6. Appointment payments
Appointment payments are processed using Stripe and may offer Apple Pay or Google Pay where supported. A connected business is responsible for charges, refunds, disputes, taxes and compliance with payment and consumer law. Elysium may display payment status and facilitate authorised actions but is not a bank or payment institution.
A saved card, deposit or card hold may be used only where the client has been shown the applicable terms and the payment provider has returned the required authorisation.
7. Plans and subscriptions
Client accounts are free. Business features may be offered through Free, Starter or Pro plans as described on the pricing page or in the relevant app store. Prices are shown before purchase and may include applicable taxes.
Web subscriptions are purchased and managed through Stripe. iOS subscriptions are purchased and managed through Apple. Android subscriptions are purchased and managed through Google Play. A paid entitlement can be used on supported devices when the same Elysium business account is used, but cancellation, billing changes and store refunds must be handled by the original billing provider.
Paid subscriptions renew for the period shown at purchase until cancelled. Cancellation stops future renewal and access normally continues until the end of the paid period, subject to refunds, chargebacks, revocation or store rules. We will give legally required notice of material price changes.
8. Optional integrations and Agent Connect
A business may connect third-party services and authorise selected information or actions. The business is responsible for choosing the provider, approving the scope and reviewing the provider's terms. Elysium is not responsible for a third-party service's independent operation.
Agent Connect gives a business-controlled external agent access only to approved Elysium scopes. The business is responsible for the agent it selects, its instructions and any action it approves. Access can be limited or revoked through Elysium.
9. Acceptable use
You must not use Elysium to break the law; mislead clients; send unlawful marketing; discriminate unlawfully; upload malicious, infringing or harmful material; access another account or business without permission; probe or bypass security; scrape the service at unreasonable scale; interfere with availability; or help anyone do these things.
We may investigate suspected misuse and take proportionate protective action.
10. Content, listings and reviews
You retain ownership of content you provide. You grant BuiltBy2 a non-exclusive, worldwide licence to host, copy, adapt for technical display and communicate that content only as needed to operate, secure and improve Elysium.
You must have the right to provide the content. Reviews must reflect genuine experiences and must not be unlawful, abusive, fraudulent or manipulated. We may moderate or remove content where reasonably necessary. A legitimate review may remain in anonymised form after the reviewer's account is deleted.
11. Elysium intellectual property
BuiltBy2 and its licensors own Elysium, including its software, branding, design and documentation. These terms give you a limited, revocable, non-transferable right to use the service for its intended purpose. They do not transfer ownership or permit you to copy, reverse engineer or commercially exploit Elysium except where law cannot restrict that activity.
12. Availability and changes
We use reasonable care to keep Elysium secure and available, but we do not promise uninterrupted or error-free operation. Maintenance, provider failures, connectivity and events outside our reasonable control may affect access.
We may update features, interfaces and technical requirements to improve the service, maintain security or comply with law. We will not knowingly remove a paid core service without appropriate notice or remedy where the law requires one.
13. Suspension, closure and termination
You may request client-account deletion or, as the owner, schedule business closure. The current process includes a 30-day recovery period. Active paid subscriptions must be cancelled with the original provider before business retirement can complete.
We may restrict or suspend access where reasonably necessary for security, serious misuse, non-payment, legal compliance or protection of users and the service. We will give reasonable notice where circumstances allow. Information may be retained after closure where the Privacy Policy or law permits it.
14. Liability
Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded.
For consumers, we are responsible for foreseeable loss caused by our breach of these terms or failure to use reasonable care, but not for loss that is not foreseeable or for business loss.
For business users, to the fullest extent permitted by law, BuiltBy2 is not liable for indirect or consequential loss, loss of profit, revenue, goodwill or anticipated savings. Our aggregate liability arising from the paid Elysium service in any 12-month period will not exceed the fees paid by that business for the service during that period, except where such a limitation is prohibited by law.
15. Changes to these terms
We may update these terms to reflect service, provider or legal changes. We will publish the effective date and give reasonable notice of material changes. Continued use after the change takes effect constitutes acceptance where permitted by law; if you do not agree, you may stop using the service and close the account.
16. Law, complaints and contact
These terms are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, subject to any mandatory right a consumer has to use the courts where they live.
